2. Providing Legal Protection – Acts as evidence in case of disputes, ensuring both parties adhere to agreed terms⁽²⁾.

3. Preventing Misunderstandings – Clearly states rules regarding rent, security deposits, and termination conditions⁽³⁾.

4. Ensuring Compliance with Laws – Helps both parties follow local rental regulations and avoid legal complications⁽²⁾.

Digital Tenancy Agreement

Validity of E-Sign or Digital Sign in Tenancy Agreements

In Malaysia, electronic signatures (e-signatures) and digital signatures are legally recognized under the Digital Signature Act 1997 (DSA) and the Electronic Commerce Act 2006 (ECA) ⁽⁴⁾.

1. E-Signature - A simple electronic signature, such as signing with a stylus or mouse, is valid if it meets the reliability conditions outlined in the ECA⁽⁵⁾.

2. Digital Signature - A more secure form of electronic signature that requires verification through a digital certificate issued by a licensed certification authority⁽⁶⁾.

For a tenancy agreement to be legally enforceable with an e-signature, it must:

i. Be attached to or logically associated with the document⁽⁶⁾.

ii. Identify the signatory and indicate their approval⁽⁵⁾.

iii. Be tamper-evident, ensuring no unauthorized modifications after signing⁽⁶⁾.
